Challenging the Stigma of Bankruptcy

biggest-bankruptcy-regrets-in-minnesotaWhen my cousin was lamenting over his finances at our last family get together, I made the (apparent) mistake of asking why he doesn’t consider talking to a bankruptcy attorney. He was aghast –eyes like saucers, jaw practically on the floor, “Oh no, no, no.” And, since the holiday had been dull so far –I challenged him. “Why not?”

He stuttered and stumbled through a couple vague excuses but what it boiled down to is that he didn’t have a single good reason why he shouldn’t consult a bankruptcy attorney.

There was a little mumbling about how a bankruptcy would look on his credit report but when I countered him with, “one bankruptcy compared to the multiple judgments that will inevitably show up if you don’t file?”

He didn’t have much to say.

The fact is this: his pride was the only reason he wasn’t even considering bankruptcy. He wouldn’t say as much but it was pretty obvious so I told him so!

Now, I could be blunt with him because we’ve known each other since we were kids. And I could challenge his gut reaction to filing bankruptcy because I have the opportunity to see how freeing it really is by working at Kain & Scott every day.

I get to hear the stories of people who were so caught up in the stigma of the word “bankruptcy” that they couldn’t even say the word!

They put off filing and put off filing until they found themselves drowning financially and saw their physical and mental health becoming affected by the stress of it all as well. It wasn’t until those medical bills began racking up that they finally came in for a consultation.

I don’t want that for my cousin –I wouldn’t want that for anyone!

Bankruptcy is a resource that is to be used and our attorneys are here to make it as easy and stress free as possible. We’re also here to make sure that there’s no shame or stigma for our clients.

I believe that it’s important for everyone to know that bankruptcy doesn’t have to mean anything other than a fresh start.
