The first step in filing a Chapter 13 Bankruptcy is to find a competent and local bankruptcy attorney who can represent you in your Chapter 13 Bankruptcy case. There are two major pitfalls to avoid in searching for competent instate licensed and local bankruptcy attorney.

First, NEVER, and I mean NEVER, call an out of state company to hire an instate bankruptcy attorney. If you think about this- why would you let an out of state non-lawyer salesperson decide if you should file bankruptcy in the first place? And then, why would you let that same non-lawyer sales person  connect you with a bankruptcy lawyer from your home state who may or may not have the best bankruptcy experience? This is insane. Don’t get entangled in this web!

Second, just like you would never want to call an out of state company and speak to a non-lawyer about Chapter 13 Bankruptcy, NEVER speak to paralegals about Chapter 13 Bankruptcy or bankruptcy at all. Paralegals are not lawyers and they cannot 1) give you legal advice, 2) quote you a fee, or 3) sign you up for a bankruptcy case. If a paralegal does any of these three, they are breaking the law and numerous ethical rules and so is the law firm that employs them.

Next, only hire a law firm that has been in existence for at least 40 years. You want a law firm that has experience not someone who is just starting out.
