The Road After Your Review & Sign

don't fear filing for bankruptcy-1You’ve just completed your review & sign appointment. You’ve gone through your petition with a Kain & Scott attorney and verified all the schedules and information is true and correct. The I’s have been dotted; the t’s have been crossed. But we’re not quite done.

When you leave our office after your review & sign you’ll have a clear picture of what the next steps are. You’ll be given a checklist of what, if anything, is still needed to file your case and your attorney will also give you the date we expect to file your case.

We don’t want you to be stuck in bankruptcy limbo between your review & sign and your filing date so here’s what to do after your meeting.

First, get us any missing information from the checklist you’ve received. It’s best to get this to us as soon as possible or before the expected filing date. We won’t be able to file your case without these documents.

After those loose ends are tied up, you will want to immediately stop all automatic payments for any credit cards or medical bills. If you don’t stop these, creditors will continuing pulling payments even after they’ve been notified of your filing since these types of “autopays” are considered voluntary on the part of the debtor.

The best way to stop these are to 1) go to your bank and tell them to cease payments or 2) call the creditors directly and then follow up in writing.

Once your documents are in and all payments to creditors have stopped –take a deep breath. The most difficult parts are over.

Once your case is filed, you’ll receive a notice from the bankruptcy court that contains your case number. Use this information to complete your second and final credit counseling course with website and code that we’ve provided.

The next step is the meeting of creditors or 341 meeting. You will receive a detailed letter from our office outlining where, when, and how to prepare. Typically these meetings take place 4-6 weeks after filing.

Once that is complete you’re in the home stretch!
